摘要:近年来,社会保障管理中出现的身份盗窃现象已经给社会保障事业带来较大的危害。本文从个人、企事业单位和社会保障部门三个方面分析了这一现象产生的原因,并提出加快立法、加强信息安全保障、健全管理体系和加大宣传教育的应对措施。

近年来,关于身份盗窃的报道不断出现。个人身份信息和识别凭证的数字化与信息化给身份盗窃作案者留下了可乘之机。身份盗窃逐渐由低技术手段向高技术手段发展,让受害者防不胜防。在社会保障管理中也遇到了身份盗窃问题,如利用社会保障卡冒领保险金及相关福利,这给社会保障事业带来较大的损失。因此,对社会保障管理中的身份盗窃现象进行研究,找出发生的原因及工作中的漏洞,避免身份盗窃给参保人员的权益带来损害,已成为当务之急。

一、社会保障管理中的身份盗窃

我国法律中没有“身份盗窃”这一罪名。社会保障管理中的身份盗窃可以理解为个人或机构利用一定技术,在社会保障信息管理系统不完备、管理者对社会保障账户信息疏于管理、个人对社会保障身份信息泄露疏于防范的情况下,窃取他人身份信息冒充他人并谋取利益、进行诈骗或从事其他非法活动。社会保障管理中的身份盗窃主要利用社保卡作为违法载体,其行为方式主要包括:冒领、盗领、租赁、借用他人社保卡领取保险金或相关福利。

二、社会保障管理中“身份盗窃”的原因

1、自我防护意识和能力薄弱

我国公民对身份盗窃了解较少,对于身份盗窃带来的危害了解更少。同时,我国公民对个人信息的保护意识也比较薄弱。在生活和工作中往往不自觉的将自己的个人信息泄露出去,对个人的社保卡及账单也不注意保管。很少有人会定期去核对自己社保账单的明细是否正确,身份被盗用后也毫不知情。当前,身份盗窃罪犯的犯罪手段逐步由低技术手段转向高技术手段,普通公民所掌握的知识有限,缺乏防范身份盗窃犯罪的知识和技能。

2、企业缺乏对个人信息的保护

企业在为员工办理入职、培训时需要登记员工的个人身份信息,为员工办理社保、社保代扣过程中需要使用员工的社保账号和社保信息。企业在经营过程中,也经常需要客户或合作公司提供相关人员的个人信息。因此,企业往往掌握大量员工和客户的个人身份信息。但是很多企业在使用和保存这些个人信息时并没有采取必要的安全防范措施,这些信息甚至被企业内部员工非法出售。

目前我国人才流动性较大,员工跳槽较为常见。社保的缴纳年限、金额等采取累计制,因此员工离职和入职牵涉到员工个人信息及参保资料的交接。企业在为员工办理完离职手续后通常不会对离职员工个人资料妥善保管,有的甚至把员工的身份证复印件、账号复印件随意丢弃,这无疑增加了身份盗窃发生的可能性。

3、社会保障管理部门需加强信息保护

社保职能部门需要加强对个人身份信息和公共档案的安全保护措施。社保部门由于工作职能的需要,广泛采集和使用海量的个人身份信息和个人缴费记录档案。社保局和基金管理中心等部门需要采取相应措施,预防个人身份信息泄露。虽然政府部门承诺对个人信息资料进行保密,且要求其工作人员对信息进行严格保密,然而在实际工作中社保机构并未做到对所有工作人员在安全使用参保者的个人资料进行充分和系统的培训和教育,致使部分员工随意使用、泄露个人信息,进而造成个人身份信息泄露和盗用。

三、社保管理中防范“身份盗窃”的措施和建议

1、加快立法

法律是维护受害者权益、惩治犯罪分子最有力的措施。法律的'缺位更容易让犯罪分子钻空子,因此,加快身份盗窃的立法迫在眉睫。目前,我国在社保方面的法律严重欠缺,仅出台了一部《社会保险法》供社保部门和参保者在办理社会保险业务中作为法律依据。该法第八十八条规定:以欺诈、伪造证明材料或者其他手段骗取社会保险待遇的,由社会保险行政部门责令退回骗取的社会保险金,处骗取金额二倍以上五倍以下的罚款。这条法律对骗保者处以较低的违法处罚,且自由裁量空间大,无形中助长了骗保者的嚣张气焰。

6月全国人大常委会通过新的刑法解释,将骗取社保的犯罪行为定为诈骗罪。此次将骗取社保行为入罪,是结合了《刑法》中诈骗公私财物的相关法律,是通过司法解释的方式,并未修改法律。同时,社保中泄露个人信息的责任难以进行调查和追究,所以掌握个人信息的各部门不会对个人身份信息的安全足够重视,也容易导致管理各方的推诿。因此,立法部门仍然应该从对身份盗窃的惩治、个人信息泄露者应承担的法律责任以及各部门对个人信息安全性和保密性的责任等角度起草和颁布法律,让身份盗窃无处可逃。

2、加强社保领域的信息安全

我国于正式启动劳动和社会保障信息系统建设,简称“金保工程”。该工程使用先进的信息技术,以中央、省、市三级网络为依靠,是覆盖全国的社保电子政务工程,支持社保业务办理、大众服务、基金监管和宏观决策等应用。金保工程利用数字证书技术,对重要信息的传输采用数据加密进行保护,并设置安全风险监测体系大大提高了系统的安全性。目前,社保部门还建立了社会保障档案的信息化管理系统,采用单位内部信息系统,仅内部工作人员可以访问系统,可录入和保存每位参保者的参保信息,并能够及时更新参保者的缴费和领取社保金等各种信息。电子档案管理在一定程度上提高了参保者个人信息的安全性和保密性。另外,社保卡内置IC卡芯片,采用数字防伪技术,采用机读方式鉴别真伪,每张卡内存有持卡人的图像,可防止社保卡被他人冒用,复制难度极高。

3、健全社会保障管理体系

健全社会保障管理体系,不仅需要严格规定工作人员使用个人身份信息的权限,还需要加强与其他部门的沟通联系和协同管理。虽然,社会保障部门在保险费的缴纳、领取,保险基金的管理、支付等方面职责划分明确,但在协同合作方面就显得不足。一方面,各部门工作人员在履行好自己职责的同时却忽略了部门间的沟通交流与信息核实,致使个人身份在被盗用的情况下仍能冒领保险金;另一方面,身份盗窃发生后,各部门相互推诿责任,给调查带来了一定困难,甚至中断了线索,无从知晓在哪个环节出现了问题。健全和完善社保管理体系,实现社保管理的零漏洞,是社保管理追求的目标。因此,加强部门间的沟通与合作,及时更新参保者个人信息,并及时完成部门间参保者个人信息的共享与核对,构建网络屏障,让企图冒领、盗领社保金的违法行为无缝插针。

4、加大宣传教育教育力度

随着社保档案数量增多,使用社保档案管理系统的人员数量也在不断增长。由于使用档案系统的工作人员的用工形式不同,人员的素质和职业操守也参差不齐,因此政府部门需要对工作人员访问个人信息的权利进行严格限定,并定期组织工作人员培训。

参保单位应将保护个人身份信息纳入公司规章制度,同时引入新技术对企业内部的信息库进行防护和监控。企业在注重人防的同时还应注重技防,可以引入信息系统身份辨识新技术、数据交换和防止信息盗窃功能的新软件,对企业内部的系统和数据库等进行防护,防止黑客侵入企业内部的网络和数据库系统,窃取员工和客户的个人资料。

社会保障部门应利用各种媒体向大众宣传个人身份盗窃的发生过程、危害性以及防范措施,提高社会大众的防范意识。首先,要及时销毁不再需要的个人社会保障账单及相关文件,特别是打印时留在公共电脑和打印机里的个人信息,因为当前的打印机、复印机大多带有存储功能。其次,将社会保障卡和对账单等印有个人信息的物品放在家里或办公室上锁的抽屉中。再次,每月初或月底收到社保账单后,仔细核对账单明细,如果发现问题及时咨询并尽快解决。
